By accessing or using RealeConstructionRx.com (“Website”), you (“Client” or “User”) confirm you have read, understood, and agree to these Terms & Conditions. If you do not accept, please refrain from using our Website and services.


Legal Disclaimer for Law Enforcement and the Public:
We do not sell or distribute drugs, medications, or any health-related products under any circumstances. We are not licensed medical professionals. The use of the term "RX" in our branding is purely a creative expression, referring to the health and well-being of homes and properties we service — it does not imply any association with the medical or pharmaceutical fields.


1. About Us & Scope of Work
Reale Construction Rx (“Company”, “we”, “us”) is a licensed, insured contractor specializing in construction, remodeling, and handyman services in New York State. Our Website provides information and tools for Clients to request quotes, schedule consultations, and communicate with our team.


2. Use of the Website

  • Users must be at least 18 years old and capable of forming contracts.

  • No spam, malicious code, scraping, or unauthorized use is allowed.

  • All access is at your own risk; Company is not liable for data breaches or downtime outside our control.


3. Intellectual Property
All content, brand assets, site design, and code are copyrighted and belong to Reale Construction Rx. Do not copy, reuse, or modify without written permission.


4. Bids, Estimates & Contracts

  • Website quotes are non-binding ballpark figures. Binding estimates require an on-site assessment and signed contract.

  • Project costs can change due to material price fluctuations, labor, unexpected site conditions, and Client scope changes.

  • All work details, payment schedules, and warranties will be explicitly stated in your contract.


5. Warranties & Limitations

Except as specifically provided in a Contract, the Company makes no representations or warranties concerning the specific quality of any services. The Company disclaims, without limitation, any warranty or guarantee of merchantability or fitness for a particular purpose, arising from course of performance, course of dealing, or from usages of trade.


6.  Cancellation Policy

  • Client will have until midnight of the third business day after signing a contract to cancel the contract prior to commencement of work as described therein. Cancellation occurs when written notice of cancellation is given to the Company. A Client who demands or accepts materials or services prior to midnight of the third business day after signing a contract will be responsible for all unrecoverable costs and/or services incurred by the Company subsequent to the Client's notice to cancel. In the event Client cancels the contract after the date referenced above, Client may be held liable for various fees and/or charges, as set forth in the termination clause in their contract.

8. Liability & Disclaimers

  • The Company's total liability for any claim arising out of or relating to the services provided, whether in contract, tort (including negligence),or otherwise, shall be limited to the total amount paid by the Client for the specific service giving rise to the claim.       

  • The Company is not liable for incidental or consequential damages, including but not limited to, loss of profits, loss of use, or damages to property not directly caused by our work. 

  • The Company is not responsible for pre-existing conditions or defects unless explicitly included in the Scope of Work to remediate such conditions. Discovery of hidden or unforeseen conditions (e.g., rot,pest infestation, structural issues) may require a change order and additional costs.

  • Certain tasks (e.g., roof work, working at heights) carry inherent risks. The Company will take reasonable precautions, but the Client assumes responsibility for site-specific risks not communicated to or reasonably discoverable by the Company.


9. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of New York. Any disputes will be handled through arbitration or small claims court in that jurisdiction.

Business Term's & Conditions

I. General Terms and Conditions (Applicable to All Services)

  1. Agreement: These Terms and Conditions (T&Cs) govern all services provided by Reale Construction Rx, INC. ("Company," "We," "Us") to the client ("Client," "You"). Acceptance of a quote, booking of a service, or payment for a service constitutes acceptance of these T&Cs.

  2. Scope of Work: The specific services to be provided will be detailed in the corresponding service description, inspection report, quotation, contract, or work order ("Service Agreement"). Any work not explicitly stated in the Service Agreement is considered outside the scope and may incur additional charges if requested and approved by both parties.

  3. Pricing & Payment:Prices for services will be as quoted or as per our current price list for "Click & Fix Home Services."
    Payment terms will be specified in the Service Agreement or invoice.

  4. Client Responsibilities:Provide safe and clear access to the work area.
    Ensure the work area is free of obstructions, personal belongings, and pets unless otherwise agreed.
    Provide necessary utilities (water, electricity) as required for the work.
    Inform the Company of any known hazards, pre-existing conditions, or specific concerns related to the property or work area prior to commencement.

  5. Changes & Additional Work:Any changes or additions to the agreed Scope of Work must be requested in writing (email sufficient) and may be subject to additional charges and an adjusted timeline.
    The Company will provide a quote or estimate for any additional work before proceeding.

  6. Rescheduling: We require at least 48 hours notice for rescheduling booked services. Rescheduling with less than 48 hours notice, or no-shows, may be subject to a rescheduling fee of $150 or 15% of the service fee which ever is greater.
    Company Rescheduling: We reserve the right to reschedule services due to unforeseen circumstances (e.g., inclement weather, emergencies). We will provide as much notice as possible.

  7. Materials:Unless otherwise specified, materials will be supplied by the Company and will be of good quality and suitable for the intended purpose.
    If the Client supplies materials, the Company is not responsible for their quality, suitability, or any defects. Any delays or additional labor caused by Client-supplied materials may incur extra charges.

  8. Insurance: Reale Construction Rx maintains liability  insurance in the amount of $1,000,000 per occurrence/$2,000,000 aggregate with Dryden Mutual Insurance Company, having an address of: PO Box 635, Dryden, New York 13053, (phone number: 800-724-0560), and shall provide (1) A certificate of workers' compensation covering all employees of the contractor or a certificate of attestation exemption (CE-200) form from the workers' compensation board; and (2) Certificates of general liability and property damage insurance in the amount of $100,000 per person, $500,000 per occurrence, bodily injury; and $100,000 for each occurrence and aggregate, property damage. Proof of insurance can be provided upon request.

  9. Permits & Approvals: Unless otherwise specified in the Service Agreement, the Client is responsible for obtaining and paying for any necessary permits, licenses, or approvals required by local authorities. The Company can assist in this process for an additional fee if agreed. 

  10. Dispute Resolution: The parties shall resolve any dispute, controversy, or claim  (“Dispute”), through the provisions of this section.                                                                                            (a)  Mediation. The parties may submit any Dispute to any mutually agreed to mediation service for mediation by providing to the mediation service a joint, written request for mediation, setting forth the subject of the dispute and the relief requested. The parties shall cooperate with one another in selecting a mediation service, and shall cooperate with the mediation service and with one another in selecting a neutral mediator and in scheduling the mediation proceedings. The mediator’s fees and expenses and the costs incidental to the mediation shall be shared equally between the parties. All offrs, promises, conduct, and statements, whether oral or written, made in the course of the mediation by any of the parties, their agents, employees, experts, and attorneys, and by the mediator and any employees of the mediation service, are confidential, privileged, and inadmissible for any purpose, including impeachment, in any litigation, arbitration, or other proceeding involving the parties, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the mediation                                                  (b)    Arbitration. In the event a mediation is unsuccessful, or the parties seek to forego mediation, all Disputes shall be resolved through binding arbitration. The arbitration, unless the parties mutually agree otherwise, shall be administered by the American Arbitration Association (AAA), in accordance with the AAA Home Construction Arbitration Rules and Mediation Procedures in e>ect on the date of this Agreement. Disputes involving claims or counterclaims that do not fall within the AAA Home Construction Arbitration Rules and Mediation Procedures; or involving more than two parties; or with issues of joinder or consolidation, shall be administered under the AAA Construction Industry Arbitration Rules in effect on the date of this Agreement. The parties shall share equally the costs of any arbitration, and same shall occur within the county where the Project is located, virtually or in person.

  11. Photographs & Marketing: The Company may take photographs or videos of the work performed for internal records, training, and marketing purposes, unless the Client explicitly objects in writing prior to work commencement. Client's personal identifying information or specific location details will not be disclosed without consent.

  12. Severability: If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  13. Governing Law:  These T&Cs shall be governed by and construed in accordance with the laws of the State of New York.

II. Specific Terms for Service Categories

Preamble for Section II: The terms in this Section II apply to services categorized by the Company based on their nature as Inspections & Consultations, "Click & Fix Home Services," or Quotation-based projects. The service names listed within each category are examples and do not represent an exhaustive list. Any new or unlisted service offered by the Company will be assigned to one of these categories, or an analogous category as determined by the Company, and the corresponding specific terms shall apply in addition to the General Terms and Conditions in Section I. The Service Agreement for any such service will further clarify its categorization and scope.

A. Inspections & Consultations (Illustrative Services Covered: Gutter Inspection, Fascia Inspection, Blinds / Shades Inspection, Doors / Windows Inspections, Trim & Molding Inspection, Smoke/CO Detection Inspection, Mirror, Art & Picture Hanging Inspection, Drywall Inspection, Roofing Inspection, Siding Inspections, Consultation)

  1. Inspection Fee: A non-refundable fee is charged for all inspections and consultations, payable at the time of booking or prior to the service. The fee covers the time and expertise to assess the condition, identify issues, and provide a report or recommendations.

  2. Scope of Inspection: The inspection is a visual assessment of readily accessible areas related to the specified service. It is not technically exhaustive and does not include destructive testing unless explicitly agreed upon and paid for.

  3. Inspection Report: A report detailing findings and recommendations will be provided. This report reflects the condition of the inspected items at the time of inspection.

  4. Validity of Inspection/Estimate:All findings, recommendations, and any associated estimates provided as a result of an inspection are valid for 60 days from the date of the report, provided the conditions of the inspected area or items remain unchanged.
    If the situation or conditions of the inspected area/items have changed in any way since the initial inspection (e.g., further damage, alterations by others, weather events), a re-inspection may be required. The fee for such a re-inspection will be [Specify Policy, e.g., the standard inspection fee or a reduced fee].

  5. Inspection Fee Credit (If Applicable):If you proceed with the Company to perform the corrective work specifically identified and quoted as a direct result of the paid inspection, the initial inspection fee [Specify Policy, e.g., will be credited OR 50% of the fee will be credited] towards the final invoice for that specific task.
    This credit applies only to the directly related work performed by the Company and quoted based on that inspection. It does not apply to unrelated services or if the work is performed by another party.
    If a re-inspection (as per II.A.4) is required due to changed conditions, the fee for the re-inspection will also be [Specify Policy if different, e.g., credited or partially credited] to the final invoice for the subsequently performed work.

  6. No Guarantee of Finding All Defects: While we strive for thoroughness, inspections may not uncover all hidden or latent defects.

B. "Click & Fix Home Services" (Repair, Installation, Adjustments, Cleanouts, Servicing) (Illustrative Services Covered: Doors / Windows Adjustment, Blinds / Shades Installation, Mirror, Art & Picture Hanging, Gutter Cleanout, Smoke/CO Detection Servicing)

  1. Booking & Payment: "Click & Fix Home Services" may be booked online or directly and may require upfront payment or payment upon completion, as specified at the time of booking.

  2. Standard Scope & Pricing: Pricing for "Click & Fix Home Services" is typically based on standard tasks, materials, and estimated time. If the actual work required significantly exceeds the standard scope due to unforeseen complexities, site conditions, or client requests, the Company will discuss any potential additional charges before proceeding further.

  3. Assumptions: Prices for "Click & Fix Home Services" assume standard conditions (e.g., standard height for gutter cleaning, readily accessible areas, standard material types). Non-standard conditions (e.g., exceptionally high gutters requiring special equipment, non-standard materials, extensive pre-existing damage beyond a simple repair) may necessitate a revised quote or reclassification as a custom job.

  4. Smoke/CO Detection Servicing: This service includes testing existing detectors, battery replacement (if applicable and batteries provided or included), and cleaning. It does not include repair of faulty units or installation of new units unless specified as "Smoke/CO Detection Inspection and Installation." Client is responsible for providing new batteries unless agreed otherwise.

  5. Roofing/Siding/Fascia Repair: These services are for minor repairs as defined in the Service Agreement (e.g., replacing a few shingles, a small section of siding/fascia). Extensive damage may require a more comprehensive quotation. Matching of existing materials (color, texture, age) cannot be guaranteed, though commercially reasonable efforts will be made.

C. Quotations (Basic, Mid-Level, Full Renovation) (Illustrative Services Covered: Full Renovation Quote | Reale RX, Mid-Level Quote | Reale Construction RX, Basic Quote | Reale Construction RX, and other large-scale or custom projects)

  1. Quotation Process: These services involve a more detailed assessment and provision of a formal written quotation for larger projects. A fee may apply for the detailed quotation process, which will be communicated upfront and may be credited towards the project cost if the Company is engaged.

  2. Quotation Validity: All quotations are valid for 60 days from the date of issue, unless otherwise stated.

  3. Payment Schedule: For larger projects, a payment schedule will be outlined in the quotation/contract, typically involving a deposit, progress payments, and a final payment upon completion.

  4. Contract: For Mid-Level and Full Renovation projects, a separate, detailed contract will be executed, incorporating these T&Cs by reference, and outlining the full scope, specifications, timeline, payment schedule, and any project-specific terms.

  5. Unforeseen Conditions: For renovation projects, if unforeseen issues (e.g., hidden structural damage, asbestos, outdated wiring/plumbing not up to code) are discovered after work commences, the Company will notify the Client immediately. A change order detailing the necessary additional work and associated costs will be presented for approval before such work proceeds.
